Preloved is a United Kingdom online marketplace where members buy and sell second-hand goods directly with each other. These terms are a contract between you and the operator of Preloved.

[To be reviewed by counsel] Insert the operating company’s full legal name, registered office address, company number and VAT number, and confirm the correct contracting entity.

You must be at least 18 years old to sell on Preloved, and you must give accurate information in your profile and listings. You are responsible for everything done under your account, so keep your login details secure and don’t share them. One account per person, please — and if you trade as a business, you must say so and use a business membership.

You can close your account at any time from your account settings or by contacting our support team. We may suspend or close accounts that break these terms, the law, or our community rules.

Preloved is a venue that connects buyers and sellers. We are not a party to any sale: transactions, payment, collection and delivery are arranged directly between members. We don’t hold funds, act as an escrow, inspect items, or transfer ownership. Always view an item before you pay and follow our staying safe guidance.

Sellers must have the right to sell what they list, describe items honestly (including faults), and set a fair, accurate price. Buyers are responsible for satisfying themselves about an item before completing a purchase.

[To be reviewed by counsel] Confirm the consumer-law position for business sellers on the platform (Consumer Rights Act 2015 obligations, distance-selling cancellation rights) and any required disclosures.

You may not list anything illegal to sell in the UK, or anything that breaks our rules — including (but not limited to): counterfeit or stolen goods, weapons, recalled or unsafe products, prescription medicines, and age-restricted goods sold to those under age. Listings for live animals must follow our animal-welfare policy, including Lucy’s Law, a minimum age of eight weeks and microchipping where required.

We may edit, hold for review, or remove any listing that breaks these rules, and we may report unlawful activity to the relevant authorities.

Browsing and basic listing are free. Paid memberships (Full, Premium and Business tiers) add benefits such as responding to new listings immediately and extra listing features. Membership payments are taken securely by card and renew automatically until you cancel. You can cancel at any time from your account — your benefits continue to the end of the period you’ve paid for, and your account then returns to Free.

You keep ownership of the words and photos you post. By posting them you give us a non-exclusive, worldwide, royalty-free licence to host, display and promote them as part of running Preloved (for example, showing your advert in search results and category pages). Don’t post content you don’t have the rights to, or content that is unlawful, misleading, or abusive.

Treat other members with respect. Harassment, discrimination, spam, and attempts to move members off-platform to defraud them are not tolerated. Keep conversations on Preloved — it protects both sides and helps us act on reports. Misusing the messaging system (including sending unsolicited marketing) may lead to suspension.

We work hard to keep Preloved available and safe, but we provide the service “as is” — we can’t promise it will always be uninterrupted or error-free, and we may change or withdraw features as the platform evolves. We are not responsible for the conduct of members, the quality or legality of items listed, or the outcome of any sale.

[To be reviewed by counsel] Liability and indemnity wording to be settled by counsel, including the caps and carve-outs that cannot be excluded under UK law (death or personal injury caused by negligence, fraud).

We may update these terms from time to time — for example when we add features or the law changes. If a change is significant we’ll tell you (by email or a notice on the site) before it takes effect. Continuing to use Preloved after a change means you accept the updated terms.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute — though if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
